General
In the following term and conditions ‘company‘ means Just Art It’ means the individual, firm, company or other party with whom the company contracts. ‘products’ mean the goods, articles and materials, which are to be supplied by the company pursuant to the contract. ‘Order’ means a purchase order in respect of the goods issued by the Customer to the company.
Prices
Our prices are VAT inclusive. All prices quoted on this website are specific to justartitgalway.com and apply to the online store only. The prices quoted are those valid at the time of production. Due to circumstances beyond our control, prices may have to be altered up or down , including any alteration to the rate of value added tax. Where the price has been quoted by the company for specific order quantities and specific delivery times, the company reserves the right to vary the price for the Goods should the Customer require different quantities from those stated or require different delivery times.
There is a minimum purchase for shipping of €15.00 for web purchases (not including shipping cost).
Delivery and Risk
Delivery of the Goods shall be made to the Customer at the place specified in the contract or as subsequently agreed between the parties and the risk in respect of the Goods shall pass to the Customer at the time of loading for dispatch to the Customer. Delivery dates are given in good faith and are adhered to as closely as possible, but no liability is accepted for any unforeseen delays subsequently arising or for any consequential loss or damage caused to the Customer or third parties as a result of any delays for whatever reason.
Force Majeure
The company shall not be liable to the Customer, or be deemed to be in breach of contract with the Customer, by reason of any delay in performing, or any failure to perform any of the company’s obligations in relation to the goods, if the delay or failure was due to force majeure or to any cause beyond the company’s reasonable control.
Payment
Unless the contract otherwise provides, the contract price for the Goods shall be payable on placement of order. We accept Visa, Mastercard & Laser cards. Just Art It is currently not selling any giftcards or course vouchers through this website.
Retention of Title
The Goods sold under these Terms and Conditions shall remain the absolute property of the company and legal title in the goods shall remain vested in the company until payment in full of all amounts invoiced or due to the company in respect of the Goods has been received. If the Customer shall enter into liquidation, have a winding-up order made against it, have a receiver, administrator or administrative receiver appointed over its assets, income or any part thereof before the property in the Goods has passed in accordance with this condition, then the company shall be entitled, immediately after giving notice of its intention to repossess the Goods, to enter upon the premises of the Customer to repossess any Goods to which it has title under this condition. No liquidator, receiver, administrator or administrative receiver of the Customer shall have authority to sell goods to which the company has title without prior written consent of the company.
Statutory Rights
These Terms and Conditions except the Customer’s statutory rights are not affected.
Applicable Law
The company only accepts orders and sells its Goods upon and subject to these Terms and Conditions which shall prevail over any terms or conditions of the Customer. These Terms and Conditions shall be governed by and construed in accordance with Irish Law and the parties acknowledge and accept the exclusive jurisdiction of the Irish Courts.
Shipping Policy
Click and Collect
Once the level 5 restrictions are lifted, you can purchase online and collect your purchases in our shop in Dominick Street. Just select “Click and Collect” in the check out. You will received a confirmation email or text when your items are ready for collection. Please note that we can only hold them here for 3 days, after that we will get in touch to arrange delivery (this might cost additional cost)
Deliveries In Ireland
As we are currently operating under restrictions, online orders will be dispatched two days per week Tuesdays and Fridays. (Please note that in the case a product is out of stock for some reason, we will contact you with the new expected delivery date). We ship all orders using An Post postage, within Ireland in parcel postage with tracking number.
If you would like to purchase from our online shop, and you are based outside of Ireland, please select payment method by invoice at the checkout, and we will send you an online invoice with the shipping price included. Please note that we cannot take responsibility, if a parcel has gone missing due to an incorrect or incomplete postal address. Items returned to us by An Post marked as not called for, or unclaimed by the receiver will require additional postage costs to be paid before we resend it. We handle our products and prints with care when packing. We do our best to ensure that no damage will occur during postage and we try to avoid the use of plastic as much as possible.
Returns
If you need to return your purchase please contact us within 7 days of delivery. Any damaged items must be highlighted to us within 7 days of receipt. Any other shortages/errors found regarding your order must also be highlighted to us within 7 days. Costs incurred in posting the returned product are not refundable.
You will be given the option of a refund for the purchase minus the shipping cost, or an exchange which will require additional postage costs to be paid before we resend it. Refunds will be made once the item has been returned, and can take up to 5 working days from when the refund is processed. Returned products must be posted to us in suitable packaging with tracked shipping.
The returned products must be in optimal conditions and in original packaging, with all original labels still attached. Proof of purchase, in the form of a receipt, and note of reason for return will be required for any products purchased from our store.
